A Grade I Area Court in Kubwa, Abuja, has dissolved a 13-year marriage between Maimuna Isah and her husband, Usman Ahmodu, using the Islamic practice of “Khuli.”

Khuli allows a woman to initiate a divorce in Islam by returning the dowry and any other items received during the marriage, or based on terms agreed upon by both parties or decided by a judge.

Presiding Judge Musa Sabo granted Isah’s request for divorce under Islamic law, citing her reasons for seeking the dissolution as dislikeness.

The judge instructed Isah to refund the N10,000 dowry to Ahmodu, referencing Order 9 Rule 3(1) of the Area Court Civil Procedure Rules.

He explained: “When a civil cause is called for hearing or at any adjournment of the hearing, if the plaintiff appears and the defendant does not, the court may, on due process of the service, proceed with the hearing and determination of the cause on the fact of the plaintiff only,” he stated.

During the hearing, Isah informed the court that her marriage to Ahmodu, which began in 2011 under Islamic law, had produced two children—a 12-year-old son and a 10-year-old daughter.

However, she expressed her desire to end the marriage, stating she no longer had an interest in continuing the relationship and was unwilling to follow her husband’s directives.

“I fear disobeying Almighty Allah as a result. I am ready to refund the dowry of N10,000 to the respondent,” Isah said.

The respondent, Ahmodu, did not attend the hearing despite being served court summons.
